P3.8 values your privacy. In this Privacy Policy (“Policy”), we describe how we collect, use and disclose information we obtain about visitors to our website, www.p3-8.com  (the “Site”), users and visitors to P3.8 Fitness Hub gym(s), and the services available through our site, and how we use and disclose that information.

By visiting the site, or using any of our services, you acknowledge that your personal information will be handled as described in this policy. Your use of our site, or services, and any dispute over privacy, is subject to this policy and our Terms of use, including its applicable limitations on damages and the resolution of disputes. The Terms of use are incorporated by reference into this policy.

Information We Collect Directly From You 

The information we collect from you depends on how you use our site and services.
When you visit the site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the site and information about how you interact with the site. We refer to this automatically-collected information as “Device Information”. 

  • To sign up for our workout programme(s). To sign up for our workout programme(s) (both online and offline) through our site or from any of our gym(s), you must provide us with your name, email address, physical address, phone number, date of birth, height and weight, payment and billing information, in order to hold your workout reservation. We also collect information about any health conditions that could affect your ability to participate in a workout.
  • To purchase products from P3.8 online. When you make a purchase or attempt to make a purchase through the site, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number. We refer to this information as “Order Information”. 

When we talk about “Personal Information” in this Privacy Policy, we are talking both about Device Information and Order Information. 

We collect Device Information using the following technologies:

  • Cookies – data files that are placed on your device or computer and often include an anonymous unique identifier. 
  • Log files – which track actions occurring on the site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps. 
  • “Web beacons”, “tags”, and “pixels” – electronic files used to record information about how you browse the Site.

How Do We Use Your Personal Information? 

  • We use the personal information to run analytics to inform your customized workout and nutrition programs. 
  • For marketing and promotional purposes in accordance with applicable laws. For example, we use your information, such as your email address, to send you news and newsletters, special offers and promotions, or to otherwise contact you about products, services, workout sessions/programmes, or other information we think may interest you.
  • We use your information (typically in the aggregate) to assist us in advertising the P3.8 brand on unaffiliated websites and in evaluating the success of our adverting campaigns (including our online targeted advertising and offline promotional campaigns).
  • To better understand how users access and use our site, both on an aggregated and individualized basis, in order to improve our Site and respond to user desires and preferences, and for other research and analytical purposes.
  • To administer our membership reward program(s).
  • To administer surveys and questionnaires, such as for market research or member satisfaction purposes.
  • To provide our services to you, to communicate with you about your use of our services, to respond to your inquiries, to fulfill your orders, and for other customer service purposes.
  • To comply with legal and regulatory obligations, as part of our general business operations, and for other business administration purposes, including authenticating your identity, maintaining customer records, to collect debts owed to us, and to safeguard our business interests.
  • We use the order information that we collect generally to fulfill any orders placed through the site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this order information to:

  • Screen our orders for potential risk or fraud; and
  • When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

Sharing Your Personal Information 

  • Health-focused Apps, Institutions and Websites. With your consent, we may share your personal information, including workout and health data, with unaffiliated health-focused mobile applications, institutions and websites to help you track your health and wellness information. If you choose to share your information with these apps, websites or institutions, your personal information, including your health information, will be used in accordance with those apps’, institutions’ and websites’ own privacy policies, not this one. Before consenting to sharing your personal information with any third party apps, institutions or websites, you should make sure that you have read, understood and agree to their own privacy policy and terms of use.
  • Affiliates. We may disclose the information we collect from you to our affiliates or subsidiaries; however, if we do so, their use and disclosure of your personally identifiable information will be subject to this Policy.
  • Service Providers. We disclose the information we collect from you to our vendors, service providers, contractors, and agents who perform functions on our behalf.

We also disclose information in the following circumstances:

  • In Response to Legal Process. We also may disclose the information we collect from you in order to comply with the law, a judicial proceeding, or any other legal process, such as in response to a court order or a subpoena.

  • To Protect Us and Others. We also may disclose the information we collect from you where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, violations of our Terms of Use or this Policy, or where it is reasonably necessary as evidence in litigation in which P3.8 is involved.

Security of Your Personal Information 

We have implemented reasonable precautions to protect the information we collect from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Please be aware that despite our efforts, no data security measures can guarantee security.

You should take steps to protect against unauthorized access to your password, phone, and computer, among other things, signing off after using a shared computer, choosing a robust password that nobody else knows or can easily guess, and keeping your log-in and password private. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.

Changes to this Policy

This policy is current as of the ‘Effective Date’ set forth above. We may change this Policy from time to time, in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons. Please be sure to check back periodically. We will update and post any changes to this policy on our Site. If we make any changes to this policy that materially affect our practices with regard to the personal information we have previously collected from you, we will endeavor to provide you with notice in advance of such change by highlighting the change on our site.
